A WREXHAM man has been jailed after he admitted indecently assaulting a child more than 20 years ago.

Malcolm Whitehall, of Tan y Coed, appeared at Mold Crown Court on Wednesday for sentencing.

The 44-year-old had previously admitted indecent assault on a girl under 16.

Jade Tufail, prosecuting, said the offence took place in the late 90s.

It was reported to police at the end of 2018 and Whitehall was arrested in 2019.

Maria Masellis, defending, said: “What took place is fortunately a relatively brief, isolated episode.

“It is of course in excess of 20 years ago now.

“It is evident from what is said in the pre-sentence report that this man has led an extremely simplistic life.

“It is said as a conclusion to the psychiatric assessment that he has mild learning difficulties - these difficulties significantly affect Mr Whitehall in his day-to-day life.

“He has effectively been incapable of holding down any type of employment.

“These proceedings have had a significant impact on his mental health and there are very real concerns.”

Mr Recorder John Philpotts told Whitehall: “This matter formally came to light in 2018.

“I take into account that you pleaded guilty.

“In my judgement, the only sentence that can be justified is one of immediate imprisonment.

“Had you been convicted by jury, the appropriate sentence would have been 20 months.

“I depart from the guidelines because of your personal difficulties and the mitigation that has been put before me and I reduce it ten per cent to have regard to your guilty plea - meaning the custodial term is one of 18 months.”

He added an extended license period of one year onto the sentence.

Whitehall must sign the sex offenders register and is prohibited from working with children.
