A man who was reported missing was found with a flat tyre and a beer bottle beside him on a Powys road, magistrates have heard.

Andrew Johnson, 29, of Brambles Walk, Wellington, Telford, had tried to make his way to the beach and said he drank in his car only after his tyre went flat and he decided to spend the night on the road.

He was found to have 71 microgrammes of alcohol in 100 millilitres of breath. The legal limit is 35mgs. He was found by police in the early hours of the morning on the A458 between Mallwyd and Foel.

He admitted being in charge of a motor vehicle while above the legal limit at Welshpool Magistrates' Court on Tuesday.

Helen Tench, prosecuting, said that Johnson had been reported missing by West Mercia Police.

The court heard that his tyre was punctured, that he had driven into the side of the road, and that there was no one else in the immediate area.

The police officers who found him said that Johnson had his eyes closed and that he had a bottle of Budweiser next to him in the car, magistrates heard.

He told the officers that he had hit the side of the road, the court heard.

When asked if he had drunk anything, he said "not not really". When the officer pointed at the Budweiser, he said "oh yeah", Welshpool magistrates heard.

"He said he was having a rough day and decided to go to the beach," Ms Tench said.

Johnson represented himself in court and said that he agreed with everything the prosecution had said.

He told magistrates that he had crashed his car after getting lost and trying to return home. He then decided to spend the night in the car and started drinking, the court heard.

He said: "I was going around in circles trying to come home."

Stephen Pembroke, chair of the bench, said: "We have decided to take points off your licence instead of disqualifying you."

He was given 10 points, which Mr Pembroke said would affect his insurance.

"But at least you can drive," he said.

He was fined £120 and was told to pay £85 in court costs and £34 in victim surcharge.
