THERE were jubilant scenes at Mold Crown Court when two men from Deeside were cleared of robbing a partially-sighted man.

Lee Kutryk and Kieran Albino cheered in the dock and there were further cheers from the public gallery.

Both had denied robbing the complainant of £20 and his Sekonda watch and said they were not involved.

The prosecution case was that Anthony Singleton was attacked and robbed after being tricked to go behind a property in Quay Wharf, Connah's Quay, to allegedly buy cannabis.

Barrister Brian Treadwell, prosecuting, said that the defendants were linked by their DNA on the complainant's clothing.

Kutryk told the jury he was innocent and that he was not there.

He said he was at his partner's home at the time.

Asked how his DNA was found on the complainant's coat, at the shoulder, he said that he had been in contact with the complainant Anthony Singleton days earlier to buy cannabis from him and might have patted him on the back.

Owen Edwards, defending, told the jury they could not be sure his client was involved.

Albino's DNA was found at the victim's back pocket but he claimed to have paid the complainant for drugs earlier.

Robin Boag, defending, suggested it was indirect transfer from a note used in payment for drugs.

If it was a note which had been used to snort cocaine earlier then the transfer of DNA could easily have happened, he said.

The complainant was said to have identified Albino from Facebook pictures but picked out someone else at an identification procedure, he said.

Mr Singleton was kicked in the face which caused him to lose several teeth.

He said he had never dealt drugs in his life and said the allegations were rubbish.

Kutryk, 24, of North Street, Shotton and Albino, 27, of no fixed abode, both deny robbery and were cleared by the jury.
