A MAN who was acting aggressively in Chester had to be sprayed with captor spray and Tasered twice before he could be arrested.

Stephen Cleary, 27, of Rhuddlan Road, Rhyl, pleaded guilty at Chester Magistrates Court on Friday, September 7 to resisting PC James Palmieri in the execution of his duty and abusive or threatening behaviour in Foregate Street on the night of August 18.

Magistrates fined him £146.

Prosecuting, Alan Curams said officers attended the scene and Cleary swore at them.

He was aggressive and verbally abusive, so police officer Palmieri went to handcuff him.

It was then that Cleary resisted arrest and the officer struggled to detain him, so captor spray was used, but did not have an effect.

Cleary then broke free, with one of his hands in the handcuffs and the other loose.

He was warned by officers they would use a Taser gun on him and ultimately it was used on his back.

Cleary was still angry and aggressive after being Tasered so a second, five-second cycle was used and this time Cleary was arrested and taken to the custody suite.

In police interview, he said he had been arguing with his girlfriend on "petty things" and had gone for a few drinks, and was about four out of 10 on a drunkenness scale.

He said he did not have any anger issues but was unhappy about ending up in custody.

He had a previous conviction for assault.

Cleary, who represented himself, did not have anything to comment in relation to the charges but had pleaded guilty at the first opportunity.

In addition to the fine, Cleary must pay court costs of £85 and a £30 victim surcharge.
