A MAN from Flintshire has been cleared of sexually assaulting another teenager at a Wrexham party.

Kane Carmichael was told by Recorder Patrick Harrington QC that he was leaving the dock “without any stain on his character”.

A jury had acquitted him of two sexual assault charges stemming from a drunken house party.

Mr Carmichael, 19, was accused of climbing into bed and sexually assaulting a 17-year-old, but he claimed the sex he had with her was all consensual.

Mold Crown Court was told the allegations arose as a result of the complainant falling ill after drinking cider and vodka shots. Her friend asked Mr Carmichael to look after her before she left the room and he climbed into the bed alongside her.

The 17-year-old claimed she woke up to find him kissing her on her lips.

When she woke again, she alleged, he committed a digital penetration offence.

But defence barrister Jo Campbell said the 17-year-old had contradicted her police statement when saying she had woken up but could not remember what had happened with any accuracy.

“He says she was reciprocating the kisses.

"She said she didn’t think she was, but it was really hazy,” said the barrister.

“He [Mr Carmichael] said she had been flirty with him all afternoon.

"When they lay under the covers she was as enthusiastic as he was.”

Mr Carmichael, 19, of Bryn Dyrys, Bagillt, denied sexual assault by touching as well as assault by penetration in April last year.

And Recorder Harrington told him as he discharged him: “I want you to get on with the rest of your life and I would like you to thank your mother and father for attending court.”
