A Prestatyn man who was accused of being involved in the supply of crack cocaine and heroin has walked free from the dock.

A £900 stash of hard drugs was found inside two Kinder eggs lying in Francie Keating’s crashed Honda car. His ex, Shereen Kelly, had to be cut out from the vehicle after the late-night crash and Mr Keating needed “life-saving” treatment from paramedics.

But the pair were accused of peddling crack cocaine and heroin under the guidance of a mystery man called “Scottish Dave” whose text messages appeared on mobile phones seized from the vehicle.

Kelly, aged 40, of Ffordd Marian, Gronant pleaded guilty to two counts of being concerned in the supply of heroin and crack cocaine on January 6 last year.

But Mr Keating, also 40, of Bangor Crescent in Prestatyn, denied two counts of possession of heroin and crack cocaine with intent to supply on the same date last year.

And after a jury sitting for more than three hours at Mold Crown Court failed to reach a verdict, Judge Niclas Parry discharged Keating and formally recorded not guilty verdicts when prosecuting barrister Ryan Rothwell revealed there were no plans to pursue a retrial.

The court heard that Mr Keating suffered serious injuries, including a broken collar bone and ribs, in the crash after the Honda veered into a tree.

Police attending the scene, at Gronant Road, Prestatyn, found 90 packages of crack cocaine and heroin inside the two eggs.

Mr Keating later told police the drugs must have belonged to “Scottish Dave”, a friend of Shereen Kelly, whom had stayed at his house.

After the crash he told a paramedic, who was about to cut his clothes off to treat him, that he was carrying about £100 of each drug for “personal use” in his waist band. He said his clothes were taken away by the police and questioned why the paramedic had not been questioned during the investigation.

Keating revealed he ended his relationship with Kelly when she confessed the drugs in the Honda were hers.

He said that while he was using drugs at the time of the crash, which explained why he had texts from suppliers on his phone, he was not and never had been a drug dealer.

Kelly will be sentenced on August 22.
