A MAN who went to investigate why his dog was barking found a man trying to get into his sun room.

Stephen Anthony Jones, 19, was ejected by householder David Johnson, Flintshire magistrates’ court was told.

He ended up assaulting Mr Johnson, although it was accepted that he had done it recklessly while flailing his arms as he was being ejected.

Jones, of Hillside Crescent in Buckley, admitted an assault charge and was placed on a 12-month community order.

He was also ordered to carry out 90 hours unpaid work and follow an alcohol course run by the probation service.

Jones, who had changed his plea to guilty on the day of his trial, was ordered to pay £50 compensation and £300 costs.

Magistrates were told that it had been accepted by the prosecution that Jones was not at the property for an unlawful reason.

He said that he had heard a scream and went to the property to see if he could help.

Mr Johnson was at home with his family in Oakfield Road, Buckley, on June 26 when the pet dog became agitated.

He went to the sun room and saw the defendant standing with one foot in and one foot out of the door.

Mr Johnson asked him what he was doing, he was given no explanation, and he took hold of him in order to evict him from the premises.

While doing so the defendant struggled, flailed his arms about and assaulted by him catching him on the cheek, causing a cut.

Phillip Lloyd Jones, defending, said that Jones accepted recklessly flailing his arms and it was on that basis that he had admitted the offence.

As the defendant was walking home he had heard a scream, saw a dog nearby,
and had gone to investigate.
