A MAN has been ordered to carry out 140 hours of unpaid work for pushing his partner into a wall on a night out.

David James Baker, 28, was convicted after a trial of assaulting his partner Paula Bather on Brook Street, Wrexham.

Wrexham magistrates heard that Miss Bather did not wish to pursue the matter but the prosecution still went ahead because of evidence from a bouncer and CCTV footage.

Explaining the circumstances, Matthew Ellis, prosecuting said during the early hours of February 21 a bouncer from South Central saw Baker “dragging” a female away. Reading evidence from the bouncer, Mr Ellis said: “The female did not want
to go with him.

“Halfway across the road another female with the pair said ‘he’s hitting her’.”

The bouncer followed the three across the road where he saw Baker dragging his partner into a toilet block and then pushing her against the wall.

“She fell to the floor and the defendant walked away,” said Mr Ellis.

When Baker was questioned by the bouncer he replied it was what she ‘deserved’ and the bouncer ‘did not know what she had done’.

During police interview Baker, of Cherry Drive, Ellesmere, said that Miss Bather had struck him during an argument in South Central.

Andy Holliday, defending, said: “It is an odd situation where the alleged victim did not give evidence for the prosecution, she gave it for the defence.

“Miss Bather became upset because she saw him talking to another girl and became jealous.

“She came into the pub and punched him to the face. He took her across the road and pushed her away from him into the wall.”

Magistrates made Baker the subject of a 12 month community order and ordered him to carry out 140 hours of unpaid work.

He was also told to pay court costs of £650.
